Senator Manchin Questions Secretary Becerra

Senator Manchin questions HHS Secretary as other states continue to stand up against PBMs and manufacturers

In an ongoing effort by states to stand up against discriminatory practices from manufacturers and PBMs, Senator Manchin (D-WV) questioned HHS Secretary Becerra on how he plans to enforce HHS’s recent response to manufacturer-led restrictions on 340B contract pharmacies. During the June 9 Senate Appropriations Subcommittee on Labor, Health and Human Services and Education hearing, Manchin noted, “The 340B program is essential for providing access to safe and affordable medications for low-income West Virginians and low-income Americans all over the country.” He then asked Becerra what his next steps will be to “ensure the integrity of the 340B program.”

This direct questioning of how HHS is going to step in and protect 340B is one of many steps being taken by state leaders to put an end to discriminatory practices that are impacting covered entities, contract pharmacies and ultimately, patients.

We applaud Senator Manchin for his support of the 340B program, for those impacted within his state and across the country. We also want to recognize leaders in these other states for stepping in to defend the integrity of 340B with legislation preventing discriminatory practices:

  • Arkansas
  • Georgia
  • Indiana
  • Minnesota
  • Montana
  • North Dakota
  • Ohio
  • Oregon
  • South Dakota
  • Tennessee
  • Utah
  • Vermont

If your state is not listed above, we encourage you to reach out to your lawmakers and encourage them to protect 340B!
